OFFICIAL RULES

  

VOID IN ALASKA, HAWAII AND WHERE PROHIBITED BY LAW.

NO PURCHASE NECESSARY TO ENTER OR WIN.

POTENTIAL Winner may be required to participate in the prize fulfillment process, including responding within FORTY-EIGHT (48) HOURS and completing and returning winner documents within TEN (10) days, as more fully detailed below.

By taking any step to participate in this SWEEPSTAKES (defined below), you understand and agree to be bound by these Official Rules, which govern all aspects of the SWEEPSTAKES.

  

1. OVERVIEW: The ALDI Mini Gear Giveaway presented by ALDI INC. (the “Sweepstakes”) begins on or about 08/11/2025 at 09:00:00 AM Central Time (“CT”) and ends on 08/13/2025 at 11:59:59 PM (CT) (the “Sweepstakes Period”).

  

2. ELIGIBILITY: The Sweepstakes is only open to persons who are permanent legal residents of and citizens who physically reside in one (1) of the forty-eight (48) contiguous states of the U.S. and the District of Columbia  (excludes Alaska and Hawaii). All entrants must be at least eighteen (18) and the age of majority in their jurisdiction of residence as of the date of entry. Employees of ALDI INC. (“Sponsor”), and their advertising or promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, franchisees, affiliates, licensees, service providers, prize suppliers, any other person or entity associated with the Sweepstakes (collectively “Sweepstakes Entities”) are not eligible to enter the Sweepstakes. Immediate family members and/or any person, whether related or not, living in the same household of an individual affiliated with a Sweepstakes Entity are also ineligible to enter the Sweepstakes. For purposes of this Sweepstakes, “immediate family members” means spouse, domestic partner, parents, legal guardian, legal ward, children, and siblings and each of their respective spouses.

By participating in this Sweepstakes, you represent that you meet the eligibility criteria, and that you agree to be unconditionally and fully bound by these Official Rules.

  

3. HOW TO ENTER: Participants are invited to enter the Sweepstakes during the Sweepstakes Period via Instagram by going to https://www.instagram.com/aldiusa/ (the “Sweepstakes Instagram Page”), log into your Instagram account, and find the Sweepstakes post on the Sweepstakes Instagram Page. Then, complete your Submission on the Sweepstakes Instagram Page by giving a “Like” to the ALDI Sweepstakes post then comment in English which of the 4 items you want (options are miniature bucket hat, miniature trouser, miniature shirt and miniature bag) along with the hashtag #ALDIMiniGear (the “Hashtag”) on the ALDI Sweepstakes post. Submission must be completed on the Sweepstakes Instagram Page and must include the Hashtag, comment of item wanted, and “Like” the Sweepstakes Post for your Submission to be eligible as an entry in the Sweepstakes.   Each entry properly submitted during the Sweepstakes Period is referred to in these Official Rules as an “Entry”.   Sponsor has the right to disqualify any Entry that is in violation of these Official Rules as determined by Sponsor in its sole and absolute discretion. Limit one (1) entry per person. Instagram account registration and following the Sweepstakes Instagram Page is free.

  

4. WINNER SELECTION: On or about 08/14/2025, 75 winners will be selected in a random drawing from among all eligible entries received, subject to verification and compliance with these Official Rules (each, a “Winner”).

  

5. PRIZE WINNER NOTIFICATION AND VERIFICATION: Potential Winner will be notified through a direct message to the Instagram social account associated with the potential Winner’s entry. Potential Winner must monitor their accounts, including “spam,” “requests” or similar folders and filters, and respond according to the information in the notification (including, if applicable, provide a preferred non-PO Box, U.S. mailing address) within 48 hours or another winner will be selected, as time permits and at Sponsor’s discretion.  

Potential Winner may be required to complete, sign and return a form and other documents (if necessary, which largely affirm the rights granted and obligations contained in these Official Rules) (collectively, the “Winner Documents”) according to Sponsor’s or Administrator’s instructions within ten (10) business days from when Sponsor or Administrator sends the Winner Documents or other time frame as specified by Sponsor or Administrator.   Failure to comply with these requirements, Sponsor’s or Administrator’s instructions, or these Official Rules may, in Sponsor’s sole discretion – having due regard of the interests of the potential Winner, result in disqualification from the Sweepstakes and forfeiture of any prize potentially won. The Winner Documents, if required, are each subject to verification by Sponsor and may require potential Winner to provide a copy of government-issued identification card or number. If any prize, prize notification, or other Sweepstakes-related communication is returned as undeliverable or if a selected potential Winner cannot be reached or does not respond as instructed in the notification, that potential Winner may – after Sponsor has taken reasonable efforts to reach the selected Winner – be disqualified and an alternate winner may be selected (time permitting and in Sponsor’s sole discretion). Sponsor will not be obligated to pursue more than two (2) alternate winners (time permitting) for any reason.

  

6. PRIZES/ODDS: The 75 verified Winners will receive one (1) item at random, options range from a miniature bucket hat, miniature trouser, miniature shirt or miniature bag. Quantities of the items are as follows: Twenty-five (25) miniature bucket hats, twelve (12) miniature trousers, thirteen (13) miniature shirts and twenty-five (25) miniature bags. One item will be mailed to Winner’s provided mailing address in Sponsor’s sole discretion. Prizes cannot be mailed to P.O. boxes. Approximate retail value (“ARV”) of each prize: Miniature Bucket Hat - $21, Miniature Trousers - $37, Miniature Shirt - $30, Miniature Bag - $16. Total ARV of all prizes in this Sweepstakes: $1,759.  The odds of winning this Sweepstakes depend on the number of entries.

To the extent applicable, the Sweepstakes Entities are not responsible for, and Winner will not receive, the difference between the actual value of the prize at the time of award and the stated ARV in these Official Rules or in any Sweepstakes-related correspondence or materials. Sponsor is not responsible for a potential Winner’s inability to accept or use the prize for any reason. Prize details will be decided in Sponsor’s and Administrator’s discretion.

Any taxes and other costs and expenses associated with prize acceptance or use and not specified in these Official Rules as being part of the prize will be the sole responsibility of Winner. Winner may be issued a tax form for the actual value of the prize.   Sponsor will not replace any lost, mutilated, or stolen prize or prize elements or any prize that are undeliverable or do not reach the Winner because of an incorrect or changed contact information. If Winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited, and Sponsor will have no further obligation with respect to that prize or portion of the prize. No transfers, prize substitutions, or cash redemptions will be made, except at Sponsor’s sole discretion. Winner is strictly prohibited from selling, auctioning, trading, or otherwise transferring any part of the prize, except with Sponsor’s permission, which may be granted or withheld for any reason in its sole discretion. Sponsor reserves the right to substitute any prize or portion of a prize with another prize or portion of a prize of equal or greater value for any reason, including unavailability of the stated prize. Each participant waives the right to assert as a cost of winning any prize any and all costs of verification and redemption or and any liability and publicity that might arise from claiming or seeking to claim said prize.

  

7. PRIVACY POLICY/PUBLICITY RIGHTS: Any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor’s Privacy Policy (located at https://www.aldi.us/online-privacy-notice/) and Terms of Use (located at https://www.aldi.us/terms-of-use/).

Except where prohibited by law and Sponsor’s Privacy Policy: (1) entry and a Winner’s acceptance of a prize constitutes permission for the Sweepstakes Entities to use in connection with the Sweepstakes or the prize awarded a Winner’s name, city and state, photo, video, likeness, biographical information, statement, voice, and any published social content for advertising/publicity purposes/product production worldwide and in all forms of media (including but not limited to brand or product packaging and posting on Sponsor’s website or any of its social media channels) in perpetuity without further notice or compensation in connection with this Sweepstakes or the prize awarded; and (2) Sponsor has the right to modify, edit, adapt, electronically alter, and/or dispose of Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties.

  

8. GENERAL CONDITIONS: The Entry Point clock will be the official timekeeper of the Sweepstakes. For purposes of this Sweepstakes, an entry is received when the completed Entry is recorded at the Entry Point by the servers that host that website or platform. Other proof of submitting or attempting to submit an entry (such as, without limitation, a screenshot of your purported entry) does not constitute proof of actual receipt or entry for purposes of this Sweepstakes. Purported entries that are incorrect or incomplete, untimely received, illegible, garbled, not in English, or contain obscene, offensive, or any other language communicating messages inconsistent with the positive images with which Sponsor wishes to associate itself (all as determined by Sponsor or Administrator in their sole discretion) will be void.   The Sweepstakes is governed by these Official Rules and the laws of the State of Illinois. By entering the Sweepstakes, entrants agree and acknowledge to be bound by these Official Rules, as well as the decisions of Sponsor which are final and binding in all respects; to waive any rights to claim ambiguity with these Official Rules; to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes or the use of any submitted Entry; and to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities. Once submitted, Entries become the sole property of Sponsor and will not be acknowledged or returned. If for any reason, the Sweepstakes is not capable of running as originally planned, Sponsor, in its sole discretion, reserves the right to cancel, suspend, or modify the Sweepstakes or any portion(s) of it and conduct the drawing from all salvageable eligible Entries received prior to and/or after (as appropriate) the action taken by Sponsor, or award the prizes in a manner that is fair and equitable. Notice of such action will be posted at the same place as the Entry point. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Any person attempting to defraud or in any way tamper with this Sweepstakes will be prosecuted and is not eligible for prize(s). In case of a dispute over the identity of a Winner, the authorized account holder of the email address associated with that Entry will be deemed the entrant. That person must comply with these Official Rules, be the person who completed the act of entering, and, in Sponsor's sole discretion, may be required to provide proof of ownership of the email account.

  

9. DISCLAIMERS: Sweepstakes Entities are not responsible or liable for multiple Entries, Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or for Entries that are illegible, late, tampered with, forged, incomplete, misdirected, deleted, damaged, lost, misplaced, stolen, destroyed, dropped, inaccessible, corrupted, jumbled, or otherwise not in compliance with these Official Rules and such Entries will be disqualified. By entering the Sweepstakes, entrants agree and acknowledge that Sweepstakes Entities will have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury, or death) in connection with participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Entry information; acceptance/possession, use/misuse, and/or defects of a prize awarded; typographical errors in promotional material; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider(s); interruption or inability to access any website (or Sponsor’s or Administrator’s inability to access content on any website), or any website or online service via the internet due to hardware or software compatibility problems; wireless network dead zones or obstructions; any damage to an entrant’s (or any third person’s) computer/mobile device, and/or its contents related to or resulting from any part of this Sweepstakes or from entering or downloading materials/software in connection with the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions even if caused by the negligence of one of the Sweepstakes Entities. Entrants hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including express warranties provided exclusively by a prize supplier that are sent along with a prize. Sweepstakes Entities will not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity that may be caused by or have contributed to: (1) any wrongful, negligent, or unauthorized act or omission on the part of prize supplier(s) (if applicable) or any of its agents, servants, employees, or independent contractors, (2) any wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsor, or (3) any other cause, condition or event whatsoever beyond the control of Sponsor or its parents, subsidiaries, and affiliated companies. The failure of the Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, strike, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

  

10.   BINDING ARBITRATION

Applicability of Arbitration Agreement. Any controversy or claim arising out of or relating to (i) the Sweepstakes (ii) the awarding or redemption of a prize, and/or (iii) the determination of the scope or applicability of these Official Rules or their enforcement or interpretation, will be resolved by binding arbitration, rather than in court, except that (1) you may assert claims in small claims court if your claims qualify, so long as the matter remains in such court and advances only on an individual (non-class, non-representative) basis; and (2) you or ALDI may seek equitable relief in court for infringement or other misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, and patents).   You agree that you must commence any arbitration or other claim within one (1) year after the dispute arises, otherwise the claim is permanently barred, which means that you will no longer have the right to assert a claim regarding the dispute.

If you agree to arbitration with ALDI, you are agreeing in advance that you will not participate in or seek to recover monetary or other relief in any lawsuit filed against the ALDI Parties alleging class, collective, and/or representative claims on your behalf. Instead, by agreeing to arbitration, you may bring your claims against the ALDI Parties in an individual arbitration proceeding (except for any Batch Arbitration, as described below). If successful on such claims, you could be awarded money or other relief by an arbitrator. You acknowledge that you have been advised that you may consult with an attorney in deciding whether to accept this agreement, including this Arbitration Agreement.

The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.

Process. To begin a claim, you must first send a letter describing your claim in detail, including your name and contact information, your legal claim, the specific facts giving rise to your claim. Your letter must include the date(s) and amount(s) of any relevant transaction or interaction with us and your requested relief. The letter must be sent to Attn: Legal Department, ALDI, Inc., 1245 Corporate Blvd., Aurora, IL 60505. You and we agree to attempt in good faith to negotiate an informal resolution of your claim. If a resolution is not reached within sixty (60) days, you may commence an arbitration action as set forth herein. Subject to the arbitration provider’s rules, your demand for arbitration must clearly identify the claimant, the claimant’s legal claims and specific requested relief and, if filed by legal counsel, proof of express authorization by the claimant to file the arbitration demand submitted with the arbitration demand. The arbitration will be conducted by JAMS, an established alternative dispute resolution provider. Unless you and ALDI agree otherwise, the arbitration will be conducted in Cook County, Illinois.

Disputes involving claims and counterclaims under $250,000, not inclusive of attorneys’ fees and interest, will be subject to JAMS’s most current version of the Streamlined Arbitration Rules and procedures available at www.jamsadr.com/rules-streamlined-arbitration/; all other claims will be subject to JAMS’s most current version of the Comprehensive Arbitration Rules and Procedures, available at www.jamsadr.com/rules-comprehensive-arbitration/. JAMS’s rules are also available at www.jamsadr.com or by calling JAMS at 800-352-5267. If JAMS is not available to arbitrate, the parties will select an alternative arbitral forum.   If your claim is for $10,000 or less, we agree that you may choose whether the arbitration will be conducted by telephone, based solely on written submissions, or by in-person hearing as established by the JAMS rules. ALDI will be entitled to make an offer of judgment in the arbitration proceeding. If the offer of judgment is not accepted, and the award is not more favorable than the unaccepted offer, you will be solely responsible for all costs incurred by ALDI after the offer of judgment is made to the extent permitted by applicable law.   Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

Fees.   If the arbitrator finds that you cannot afford to pay JAMS’s filing, administrative, hearing and/or other fees, and you cannot obtain a waiver from JAMS, ALDI will pay them for you. If the arbitrator determines the claims are frivolous, you agree to pay ALDI’s attorneys’ fees and costs in the arbitration, to the extent permitted by applicable law.

Authority of Arbitrator. The arbitrator, and not any federal, state or local court or agency will have exclusive authority to resolve any dispute related to the interpretation, applicability, enforceability or formation of this Arbitration Agreement including, but not limited to, any claim that all or any part of this Arbitration Agreement is void or voidable. The arbitration will decide the rights and liabilities, if any, of you and ALDI. The arbitration proceeding will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator will have the authority to grant motions dispositive of all or part of any claim. The arbitrator will have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the arbitral forum’s rules, and these Terms of Use (including the Arbitration Agreement). The arbitrator will issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. The award of the arbitrator is final and binding upon you and us.

Waiver of Jury Trial. You and ALDI hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury. You and ALDI are instead electing that all claims and disputes will be resolved by arbitration under this Arbitration Agreement, except as specified in (a) of this Arbitration Agreement above. An arbitrator can award on an individual basis the same damages and relief as a court and must follow this Arbitration Agreement as a court would. However, there is no judge or jury in arbitration, and court review of an arbitration award is subject to very limited review.

Waiver of Class or Consolidated Actions. Except with respect to Batch Arbitration (as defined below), all claims and disputes within the scope of this Arbitration Agreement must be arbitrated on an individual basis and not on a class basis, only individual relief is available, and claims of more than one customer or user cannot be arbitrated or consolidated with those of any other customer or user. In the event that this subparagraph is deemed invalid or unenforceable neither you nor we are entitled to arbitration and instead claims and disputes will be resolved in a court as set forth in the “Jurisdiction and Applicable Law” section below.

You and ALDI agree that, in the event that there are fifty (50) or more individual requests for arbitration of a similar nature filed against ALDI within an approximately (60) sixty-day period (or otherwise in close proximity) regardless of the state(s) in which such claims are filed, JAMS will administer all such similarly situated arbitration demands on a collective basis as a single, consolidated arbitration (subject to a single set of fees, proceeding schedule, and, if required, hearing) before a single arbitrator in accordance with the requirements outlined elsewhere in this section, provided that – in the event that the arbitrator deems it impracticable or inequitable to administer all such claims collectively in a single arbitration – (s)he may group demands for arbitration into groups of not fewer than fifty (50) matters, plus a remainder group as needed (or as otherwise deemed by the arbitrator to be practicable, equitable, and in best keeping with the spirit of this provision) and arbitrate each group of matters as a single, consolidated arbitration (either structure a “Batch Arbitration”). You and ALDI agree (1) to work with JAMS in good faith to facilitate the resolution of disputes on a Batch Arbitration basis and (2) that requests for arbitration are of a “similar nature” if they arise out of the same event, agreement, or factual scenario and raise the same or similar legal issues and seek the same or similar relief. Disagreements over the applicability of this Batch Arbitration process will be settled in a single, consolidated arbitration proceeding that includes all affected parties and is resolved by a single arbitrator subject to the requirements of this section. This Batch Arbitration provision shall in no way be interpreted as authorizing a class or collective arbitration or action of any kind, or any suit or arbitration involving joint or consolidated claims, under any circumstances other than those expressly set forth in this section.

Severability. If any part or parts of this Arbitration Agreement are found under the law to be invalid or unenforceable, then such specific part or parts will be of no force and effect and will be severed and the remainder of the Arbitration Agreement will continue in full force and effect.

Survival of Agreement. This Arbitration Agreement will survive the termination of your relationship with ALDI.

Modification. Notwithstanding any provision in these Rules to the contrary, we agree that if ALDI makes any future material change to this Arbitration Agreement, it will not apply to any individual claim(s) that you had already provided notice to ALDI.

  

11. JURISDICTION AND APPLICABLE LAW: To the extent any claim, dispute or controversy regarding ALDI or our Services is not arbitrable under applicable laws or otherwise: you and ALDI both agree that any claim or dispute regarding ALDI will be resolved exclusively in an Illinois court governed by the laws of the State of Illinois, without respect to its conflict of laws principles. The exclusive place of jurisdiction for all disputes arising from or in connection with this agreement is Cook County, Illinois, or the United States District Court for the Northern District of Illinois and our dispute will be determined under Illinois law. If you are a consumer in the EEA, the Arbitration Agreement does not apply to you. You are responsible for informing yourself of the laws of your jurisdiction and complying with them.

  

12. LIMITATION OF LIABILITY: Each participant hereby acknowledges and agrees that the relationship between them and each of the Sweepstakes Entities is not a confidential, fiduciary, or other special relationship, and that their decision to participate for purposes of the Sweepstakes does not place any of the Sweepstakes Entities in a position that is any different from the position held by members of the general public, other than as set forth in these Official Rules.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTICIPANT AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY EACH OF THE SWEEPSTAKES ENTITIES FROM AND AGAINST ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE USE OF THE SWEEPSTAKES WEBSITE (IF ANY) OR THE ACCEPTANCE, USE, MISUSE, OR AWARDING OF A PRIZE OR WHILE PREPARING FOR, OR PARTICIPATING IN ANY PRIZE- OR SWEEPSTAKES-RELATED ACTIVITY INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, LOSS, DEATH OR ACCIDENT TO OR OF PERSON OR PROPERTY. THE PRIOR LIMITATION ON DAMAGES IS NOT INTENDED TO LIMIT THE SWEEPSTAKES ENTITIES’ OBLIGATION (IF ANY) TO PAY PREVAILING PARTY COSTS OR FEES IF RECOVERABLE PURSUANT TO APPLICABLE LAW. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE THE SWEEPSTAKES ENTITIES’ LIABILITY FOR PERSONAL INJURY OR TANGIBLE PROPERTY DAMAGE CAUSED BY THE SWEEPSTAKES ENTITIES, OR FOR THE SWEEPSTAKES ENTITIES’ GROSS NEGLIGENCE, FRAUD, OR INTENTIONAL, WILLFUL, MALICIOUS, OR RECKLESS MISCONDUCT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, THEIR QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

  

12. SEVERABILITY AND HEADINGS: If any provision of these Official Rules is found to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Official Rules and will not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience or reference and will not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision in these Official Rules.

  

13. OFFICIAL RULES / WINNERS LIST: To receive a copy of the Official Rules or the Winners list, send a self-addressed stamped envelope to: ALDI Mini Gear Giveaway Presented by ALDI “Rules” or “Winners” (specify which), ALDI INC., 1200 N. Kirk Road, Batavia, Illinois 60510 or email PR@aldi.us with the subject line ALDI Mini Gear Giveaway “Rules” or “Winners” (specify which). The Winners list will be available one week after the end of the Sweepstakes Period. All requests must be received within three (3) months of the time of the drawing as described above.
